You Bring The Talent Contest ("Contest")
OFFICIAL RULES TO ENTER, YOU MUST READ THE OFFICIAL RULES BELOW AND AGREE TO THE RULES BY CLICKING "SUBMIT" WHERE INDICATED. NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 16 YEARS OF AGE OR OLDER AND LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.
1. ELIGIBILITY REQUIREMENTS: Open to legal residents of the fifty (50) United States and the District of Columbia who are 16 years of age or older at the time of entry. Void where prohibited. Employees, contractors, directors and officers of Uber, Inc. ("Sponsor"), its parent, subsidiary and affiliated companies, distributors, web design, advertising, fulfillment, judging and contest agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, "Contest Parties"), and the immediate family members of each (spouse, parent, child, sibling, grandparent, and spouse or "step" of each) and those living in the same households of each (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Contest) are not eligible to participate.
2. CONTEST ENTRY PERIOD: You may enter the Contest between 12:00:00 am Pacific Time ("PT") on 1/4/08 and 11:59:59 pm PT on 3/31/08 ("Contest Period").
3. TO ENTER: To enter the Contest, you must first register for a free Uber account at www.youbringthetalent.com or http://youbringthetalent.uber.com ("Web Sites"), if you are not already a registered member. To register, follow on-screen directions to properly complete and submit a registration form. For your registration to be valid, you must complete all required information and click on the "Submit" button on the registration page. Once registered, sign in and click on the You Bring The Talent Contest link. You will be requested to submit and upload an original song created by you and/or your band ("Entry"). The uploaded original song must be an MP3 file and no larger than 15 MB. The Entry in its entirety will be judged on the criteria listed below. All Entries must be received by 11:59:59 pm PT on 3/31/08. Entries: must be the original work of the entrant and his/her band; may not have won previous awards; may not have been published previously by any third party (i.e., record label); must not infringe any third-partyâs rights; must be suitable for publication (i.e., may not be obscene or indecent); must not contain obscene or pornographic material; may not contain defamatory statements; may not invade privacy or other rights of any person, firm or entity; may not in any other way violate applicable laws and regulations; may not contain any reference to any third party trademarks, names or third party logos; and may not contain any copyrighted works owned by third parties, including but not limited to "samples" of other songs. All Entries will be reviewed for content before being judged. Entries containing prohibited or inappropriate content as determined by the Sponsor, in its sole discretion, to be inappropriate will be disqualified. Sponsor makes the final determination as to what Entries are eligible to take part in this Contest. Submission of an Entry grants Sponsor and its agents the unconditional right to publish, use, adapt, edit and/or modify such Entry in any way, in any and all media, without limitation, and without consideration to the entrant, whether or not such submission is selected as a winning Entry. BY SUBMITTING THE ORIGINAL MUSIC, THE ENTRANT REPRESENTS AND WARRANTS THAT HE/SHE HAS ALL RIGHT, TITLE AND INTEREST NECESSARY TO GRANT THE SPONSOR THE UNRESTRICTED RIGHT AND LICENSE TO POST THE ORIGINAL MUSIC ON THE INTERNET OR USE THE ORIGINAL MUSIC IN ANY OTHER WAY.
4. SELECTION OF WINNERS: There will be one (1) round of public voting to determine the top one hundred (100) finalists ("Finalists") (including ties) in the Contest. All eligible Entries received between 1/4/08 at 12:00:00 am PT through 3/31/08 at 11:59:59 pm PT ("Voting Period") will be available for voting by the public. During the Voting Period, the public will have the opportunity to view and to vote for their favorite original song online at www.youbringthetalent.com or http://youbringthetalent.uber.com by accessing an Uber memberâs registered Artist page and clicking on the "Vote" button. You must register for a free Uber account if you are not already a member prior to voting. There is a limit of one (1) vote per person/e-mail address per Day of the Voting Period. A "Day" is defined as the 24 hours between 12:00:00 am PT and 11:59:59 pm PT throughout the Voting Period. The use of automated voting is strictly prohibited and suspect votes will be disqualified. One account per person. Voting through multiple accounts is strictly prohibited. Once the top one hundred (100) Finalist Entries have been determined, they will be judged by a process in which a qualified panel of judges ("Judges") who will evaluate each eligible Finalist Entry based on the judging criteria outlined below on or about 4/7/08 to determine a grand prize winner ("Grand Prize Winner"). There will be two (2) people's choice ("Peopleâs Choice") prizes available for the Contest and these will be awarded to the entrants who receive the most votes during the Voting Period. In the event one of the People's Choice winners is chosen by the Judges as the Grand Prize Winner, the next highest ranked Finalist will win the other People's Choice prize.
5. FINALIST JUDGING CRITERIA: Each eligible Finalist Entry will be judged based on the following criteria: ⢠Musicianship (25%) - Technical and creative ability to play an instrument and/or quality of voice. ⢠Songwriting (25%) - Quality of lyrics and music. ⢠Stage Presence (25%) - Charisma, ability to capture and hold audiences attention, and overall style. ⢠Live Performance (25%) - Ability to play cohesively (as a single unit) or appropriate to your style of music. In the event of a tie, the tie breaker will be based on the highest score in the first Judging Criteria, continuing thereafter to each Judging Criteria in order, as needed to break the tie. Entrants agree that the Judges have the sole right to decide all matters and disputes arising from this Contest and that all decisions are final and binding.
6. ONE (1) GRAND PRIZE: a 5 song EP deal with Atlantic Records with an option to sign an album deal. Package also includes a trip for one (1) verified Grand Prize Winner and up to four (4) eligible guests ("Winnerâs Guests"), who must be active musicians in the winning group, to Los Angeles, CA to showcase at the House Of Blues on the Sunset Strip for MusExpo 2008 on 4/28/08. Trip includes round-trip coach air transportation from a major gateway airport near Winnerâs residence within the U.S.; 4 days/ 3 nights (4/26/08 â 4/29/08) of hotel accommodations which include up to three (3) hotel rooms with double occupancy; ground transportation to/from airport/hotel; a MusExpo 2008 convention participation pass; recording studio time; a music publishing deal with Peer Music Publishing; tour booking in the United States from The Agency Group; and guaranteed distribution thru ADA from The Rebel Group. Approximate retail value ("ARV") of the Grand Prize trip is up to $8,150. Actual value may vary depending on Winnerâs point of travel origin, airfare and hotel fluctuations. Any difference between stated ARV and actual value will not be awarded. Airport and hotel accommodations for the Grand Prize are to be selected by Sponsor. All meals, gratuities, ground transportation, and other expenses associated with the Grand Prize not specifically mentioned in these Official Rules are the Winnerâs sole responsibility. You must be able to travel on dates specified by Sponsor (4/26/08 â 4/28/08), or Grand Prize will be forfeited. Winner and Winnerâs Guestâs must travel on same itinerary. Winner and/or Winners Guestâs participation in any or all activities on the Grand Prize trip is voluntary. TWO (2) PEOPLEâS CHOICE PRIZES: Peopleâs Choice original song prominently placed on the MusExpo 2008 CD sampler. There is no monetary value associated with this prize.
7. GENERAL CONDITIONS: Grand Prize Winner is solely responsible for any taxes on the Grand Prize, and Grand Prize Winner will receive an IRS Form 1099 for the ARV of the Grand Prize. No cash equivalent or substitution of any prize is offered, except at the sole discretion of the Sponsor. Prizes are non-transferable, non-refundable and have no cash value. By participating, entrants agree to these Official Rules and Sponsors Privacy Policy (available at http://www.uber.com/terms_of_use.html) which are final and binding in all respects. Unclaimed prizes will not be awarded. Winners will be notified by phone and/or mail and will be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release within seven (7) days of attempted notification or prize may be forfeited. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and to cancel, modify or terminate the Contest. This Contest is offered only in the United States and is governed by the laws of the state of California, with venue in Los Angeles County, California, and all claims must be resolved in the federal or state courts located in Los Angeles County, California.
8. LIMITATIONS OF LIABILITY AND RELEASE: All online entrants must have a valid e-mail address. No liability or responsibility is assumed by Sponsor or Contest Parties resulting from user's participation in or attempt to participate in the Contest or download any information in connection with participating in the Contest. No responsibility or liability is assumed by the Sponsor or Contest Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent to or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Web Sites in whole or in part for any reason; traffic congestions on the Internet or the Web Sites; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Contest, or loss, miscount, misdirection, inaccessibility or unavailability of an account used in connection with the Contest. Sponsor is not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Sites. Use of Web Sites is at userâs own risk. Sponsor and the Contest Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer equipment resulting from participation in the Contest, use of the Web Sites or the download of any information from the Web Sites. By participating in the Contest, the entrant thereby releases Sponsor and Contest Parties from any and all claims, damages or liabilities arising from or relating to such entrantâs participation in the Contest. By accepting a prize in the Contest, Winners agree that the Sponsor and Contest Parties shall not be liable for any loss or injury resulting from participation in the Contest, acceptance or use of any prize, or any travel related thereto. Except if Winner is a resident of TN, or where prohibited by law, by accepting prize, Winner grants permission for Sponsor and those acting under its authority to use his/her name, photograph, voice and/or likeness, for advertising and/or publicity purposes, in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation.
9. WINNER LIST/RULES REQUEST: For winner names or Official Rules, log on to www.youbringthetalent.com or http://youbringthetalent.uber.com. Winner names and Official Rules will be available on the Web Sites until 4/30/08.
